Requests from competent authorities.

This page governs how law enforcement agencies, regulators, tax authorities and courts serve lawful process on NioX, the spot exchange operated by NIO X PTE. LTD., registered in Singapore. Account holders must use the support page. A request submitted through any other channel is directed back to this page and is treated as served only once it reaches the compliance team in the form set out here.

NioX discloses customer data only where it is compelled by valid legal process or is otherwise permitted by law. NioX reserves the right to verify every request, to require valid legal process and to narrow or decline any request that is unlawful, overbroad or outside the jurisdiction that binds NIO X PTE. LTD. A request that states no legal basis, or that issues from an authority with no lawful reach over NioX, is declined in writing with the reason recorded.

01How to submit a request

Serving a request on NioX.

Serve the request on the compliance team at the address for service from an official domain of the authority that issues it. A request from a personal address or a free email domain is not accepted and is not treated as served. The request must be attached as a signed instrument on the official letterhead of the authority.

We verify then respond

NioX verifies every request by contacting the issuing authority on a number it establishes independently. Response times run only once the authority and the request are verified.

02Before you send

What a request must include.

A complete request is verified and answered without delay. Each request must set out the following as a condition of being actioned.

The identity of the requesting authority, the name and rank of the responsible officer and a direct telephone number and official email address at which that officer can be verified.

The legal basis relied on, stated in full, including the statute, the article and the instrument under which the request is made.

The case or reference number of the investigation or proceeding to which the request relates.

The identifiers of the account or accounts concerned. A NioX account identifier, a registered email address, a deposit address or a transaction hash is sufficient. A name on its own is not sufficient to identify records.

The precise records sought and the period they cover. A request for all records held without limitation is refused as disproportionate and overbroad.

The date by which a response is required and a clear statement of whether the matter concerns an imminent risk to life.

Whether a prohibition on disclosure to the account holder applies and the instrument that imposes it, together with the period for which it runs.

03Response times

Categories of request and indicative response times.

Response times run from verification of the authority and the request, not from the date of the email. Verification is completed by contacting the authority on a number NioX establishes independently. The two lanes below are worked ahead of routine correspondence.

Imminent risk to life

Emergency disclosure

Where there is an imminent risk of death or serious physical harm, NioX discloses the records needed to address that risk once it is verified. A request is assessed on receipt at any hour of any day.

Preservation

Records held at the time of receipt are preserved so that they are not lost to routine deletion. Preservation is actioned within twenty four hours of verification and held for ninety days.

04What we can provide

Records we hold and the basis for sharing them.

NioX discloses customer data only where it is compelled by valid legal process or is otherwise permitted by law, and it discloses no more than the records the request lawfully reaches. A request that states no legal basis, or that issues from an authority with no lawful reach over NioX, is declined in writing with the reason recorded. NioX retains the records below under the permissions it holds to operate as a spot exchange. NioX informs an account holder of a request for their records unless the law or the order served prohibits it, or unless notice would endanger a life or prejudice an investigation into a threat to life.

Subscriber records
Registered name, date of birth, residential address, email address and telephone number. Retained for at least five years after the end of the relationship.
Identity verification records
The identity document submitted and the verification result. Retained for at least five years after the end of the relationship.
Account balances and holdings
Balances and holdings by asset. Retained for at least five years.
Order and trade records
Price, quantity, time and the side of each counterparty. Retained for at least five years.
Deposit and withdrawal records
Network, address, transaction hash and the counterparty where known. Retained for at least five years.
Login records
Time, internet protocol address and device. Retained for twelve months unless held longer for an investigation.
Communications with support
Messages exchanged with the support team. Retained for six years after the matter is closed.
Private keys and credentials
Not held in any recoverable form and cannot be produced.
Plain text passwords
Never stored and cannot be produced.
05How we handle a request

From notice to delivery.

How a lawful request is handled once it reaches the compliance team, from the notice given to the account holder through verified delivery and the controls that guard against fraud.

Telling the account holder
NioX informs an account holder of a request for their records unless the law or the order served prohibits it, or unless notice would endanger a life or prejudice an investigation into a threat to life. Where a prohibition applies for a fixed period, notice is given once that period expires unless a further prohibition is served.
Cost and format
Records are produced in a machine readable format with a certificate of authenticity signed by an authorised officer of NIO X PTE. LTD. Where an authority requires a particular format, that requirement should be stated in the request. No charge is made for a preservation request or for an emergency disclosure request. Where production requires substantial manual work, NioX may recover its reasonable costs where the law permits and states the estimated cost before the work begins.
People posing as officers
Fraudsters pose as law enforcement to obtain customer data. NioX verifies every request by contacting the issuing authority on a number it establishes independently rather than one supplied in the request, and the officer who issues the request is asked to expect that call. An officer who obstructs this check is treated as a fraud attempt and the matter is reported.
